Directive (EU) 2015/1535
Directive (EU) 2015/1535 sets up a tool for preventing emergence of new obstacles to free movement of goods that could arise from adoption of national legislation encompassing products and information society services (technical regulations in a non-harmonized area).
Generally binding legislation that is a technical regulation in a non-harmonized area shall be notified in accordance with the Directive (EU) 2015/1535 procedure. It becomes subject of the intra-Community comment procedure within which the Commission, the Member States and other entities (eg EFTA Member States) can submit their comments about a notified draft.
According to the ruling of the European Court of Justice C-194/94 in the „CIA Security case“, the regulation that has not undergone the notification procedure under Directive (EU) 2015/1535 is legally unenforceable.
The notified draft technical regulations of all EU member states are available in the European Commission's TRIS database.
For information exchange among the Slovak Republic, the European Commission and other EU Member States, a Contact Point for Directive (EU) 2015/1535 was established at the UNMS SR. Within the Slovak Republic, the Contact Point provides for communication with appointed contact persons at respective Ministries, other state administration bodies, and higher territorial units.
